Supreme Court Victory – $550 Million for Public School Employees
White Schneider is happy and honored to report the major victory for Michigan school employees on the seven-year long litigation to return more than a half billion dollars illegally taken from school employees in the long-running "3%" case. By Order dated December 20, 2017, the Michigan Supreme Court unanimously upheld lower court rulings that found the withholding to be illegal on a variety of constitutional grounds. Logistics will need to be determined for how school employees will receive the refund of over $550 million that has been held in escrow since 2010-2012. Kathy Corkin Boyle, recently retired attorney and former partner, was honored by the Michigan State Police Troopers Association and its membership at their October Quarterly retreat for over 30 years of service and representation she provided as both in-house and outside counsel for the organization. $550 Million for Public School Employees
Over six years ago, White Schneider initiated a lawsuit on behalf of public school employees challenging the imposition of a mandatory 3% deduction from their wages to fund the present costs of providing retiree healthcare. Today that fight still continues. On July 7, 2016, the Michigan Court of Appeals has ruled a second time that the imposed deduction violated three separate provisions of the Michigan and United States Constitutions. Despite the Attorney General declaring that his office would no longer represent the State to continue any litigation, Governor Rick Snyder appointed special counsel to file an application for leave to appeal with the Michigan Supreme Court.
